1. Contents of the web page

MOVEMENT SKIS (website's editor) controls and keeps the web page up to date. MOVEMENT SKIS does not guarantee the accuracy, comprehensiveness or quality of the information on the web page. All offers are without engagement and are a non-binding offer. The website editor reserves the right to modify, add to, and cancel individual pages or the whole online offer without any notice, as well as suspend an offer temporarily or definitively.

MOVEMENT SKIS is not responsible for other web page content which are linked to a MOVEMENT SKIS offer, for example hyperlinks. This applies as well to comments from anyone in the guestbook, forum, discussion, public web pages and mailing list created by the website's editor.

3. Copyright and image / logo

The MOVEMENT SKIS web page content and structure are protected by copyright. Reproduction of graphics, sound recording, photography, films, video and text are not allowed without permission of MOVEMENT SKIS. This includes other supports or electronic publications.

4. Data protection statement

The protection of personal data is our prime priority when data is collected, processed and used. All MOVEMENT SKIS employees are subject to confidentiality. Below you will find some information about how your personal data is saved on our web page and used.

A. Social network — Facebook plug-in use

Our web page uses the Facebook social network plug-in, operated by Facebook Inc. ("Facebook"). You will recognize the Facebook plug-in thanks to the Facebook logo or a characteristic "Facebook plug-in sign". If you visit a page with a Facebook plug-in, your browser connects directly with the Facebook host. We do not have any influence on this process, nor on the quantity of information that Facebook collects. If you are a Facebook member and do not want Facebook to collect information when you visit our web page, please log out of your Facebook account before visiting. B. Use, transfer, deletion or blocking of personal data

We only use your personal data to answer your requests, to fill out contracts concerning you, for advertising purposes or technical administration. Your personal data will not be transferred or communicated to others unless necessary to conclude your contract (for example, reservation or billing), and always with your approval. Saved personal data is deleted once no longer required, subject to legal, statutory or contractual retention periods.

C. Right of withdrawal

You can revoke your agreement about data use and transfer at any time by email to info@movementskis.com or by letter.

D. Data security

We take all necessary measures to prevent our personal data backups from being released to third parties. With email communication, we cannot guarantee complete data security; we suggest communicating with us via letter or phone where possible. Information transferred via email is at your own risk.

5. Terms & conditions of sale

A. Acceptance of these general terms and conditions of sale

These general terms and conditions of sale (the "General Terms and Conditions") apply to the sale and delivery in Switzerland and/or Europe of products (the "Products") ordered on the www.movementskis.com website and/or on all affiliated websites, operated by Movement SA, Rue du Jura 10, 1800 Vevey, or any affiliated entity ("Movement"). In order to place an order on the website (the "Order"), you must accept the General Terms and Conditions as well as the Data Protection Declaration. The General Terms and Conditions may be modified at any time by Movement; the latest version will apply to any Order placed once published on the website.

B. Conditions concerning the customer

By placing an Order on this website, you confirm that you are able and entitled to enter into a contractual commitment, that you are 18 years of age or older, and that you are a real person purchasing Products for private use and not for commercial use. It is your responsibility to provide accurate and complete information.

C. Order and transfer of ownership

The Products listed on the website constitute an invitation to tender. By submitting an Order, you are submitting an offer to purchase (the "Offer"). The sales contract (the "Sales Contract") is concluded once Movement accepts the Offer, i.e. confirms availability of the Product(s) ordered. If an Order covers several Products, confirmation may be partial. Delays or stock shortages may occur, in which case an Order may be cancelled in whole or in part even after a confirmation email; any amount already paid for cancelled items will be refunded as soon as possible, excluding any other compensation. Ownership and risk transfer to you upon delivery to the address you provided.

D. Prices and payment

Prices displayed on our website are gross and include all taxes (including VAT), shown in Swiss francs (CHF). Delivery costs, payment-related costs, and (for European orders) customs duties may apply in addition. Prices may change at any time; the Sales Contract is concluded at the price shown at the time of the Order. If an item is listed at an incorrect price below cost, we reserve the right to process the Order at the correct price or offer you the option to cancel. Payment is generally due immediately; we reserve the right to delay delivery until full payment is received. We accept payment by major credit and debit cards; no financial information passes through Movement's own servers.

E. Promotional codes

Promotional codes are non-transferable and must not be shared with third parties. In case of abuse, Movement may withdraw from the Sales Contract, reclaim the Products, and charge administrative costs.

F. Delivery

Products are sent to the delivery address you provide. Delivery costs of CHF 6.90 (VAT included) apply for orders under CHF 100.00 excluding tax; delivery is free above that amount. Delivery typically takes two to seven working days from dispatch, given as an indication only. Movement is entitled to make partial deliveries.

G. Right of return

Products ordered from the website may be returned without justification. To exercise this right, email info@movementskis.com within 14 days of delivery. Products must then be returned within 14 days to: Movement, Rue du Jura 10, 1800 Vevey, Switzerland. Only intact, unopened and unused Products will be accepted, with the delivery note included. Sale items and safety equipment such as helmets cannot be returned. Refunds exclude delivery costs and payment-related fees. Return shipping costs and risk of loss or damage in transit are borne by the customer.

H. Duty to verify the order — notice of defects

You must inspect Products upon receipt and notify Movement of any apparent defects within 48 hours. Without such notice, Products are deemed received in good condition and the Order accepted as delivered, except for non-visible defects, which must be reported as soon as discovered, otherwise warranty rights may be forfeited.

I. Guarantee

Subject to the notice obligations above, all Products sold by Movement carry a 2-year guarantee from the date of delivery. Products purchased through other channels should be handled directly with the original seller. For products purchased on our online shop, email sav@movementskis.com to start the warranty process. In case of a proven defect, Movement will choose, at its discretion, between a refund, a voucher of equivalent value, or repair or replacement. The guarantee does not cover damage from external causes (impact, falls, moisture), misuse, unauthorized modification or repair, or normal wear and tear. Warranty claims should be made directly at a Movement retailer with the invoice and completed warranty form; shipping costs for a warranty claim are at the discretion of the store. Any modification other than the initial ski binding mounting fully voids this guarantee. Examples not covered: normal wear (scratches, sun discoloration), impact damage, damage from inappropriate use (e.g. skiing with blocked touring bindings), and damage from using telemark bindings on touring skis.

J. Miscellaneous

You may not assign or transfer your rights or obligations under the Sales Contract without our prior written consent. If any clause of these General Terms and Conditions is found invalid, the remaining clauses stay valid, and the invalid clause will be replaced with one that best reflects the parties' original intent. These General Terms and Conditions, together with the Website's legal pages, form the entire agreement between the parties. Failure to exercise any right does not waive that right for the future. These General Terms and Conditions are governed by Swiss law, excluding conflict-of-law rules and the CISG. The exclusive place of jurisdiction is Vevey, Switzerland.
